Uncontested Divorce Kit
If you wish to file for divorce, you may be able to use the do-it-yourself Uncontested Divorce Kit. The kit contains legal information related to the uncontested divorce and the forms needed to complete the process.
We have made every effort to make sure that the information contained in the package is up to date. However, the laws and rules about divorce and related issues are evolving and often change—check that the information is current before you use it to apply for divorce.
Important Information Before You Proceed
To use the kit:
- you and your spouse must have been separated for at least one year
- one of you must have lived in PEI for at least one year
- you and your spouse need to have settled issues around the division of property, child custody, child and spousal support
If you wish to apply for a divorce and there are issues between you and your spouse that have not been settled, you should speak with a lawyer. Even if you believe there are no issues left to settle, it is a good idea to meet with a family law lawyer to make sure that all matters are settled, and to be sure that you have thought about everything that may be related to your divorce. Child of the Marriage definition
According to the Divorce Act, a child of the marriage means a child of the two spouses who is under the age of majority and who is still in their care, or a child who has reached the age of majority but is unable to live independently because of an illness, disability, or other cause. A child of the marriage can be a child for whom both spouses are their parents or a child for whom one or both spouses stand in the place of a parent. This also includes any children of the couple born before the marriage.
Children over the age of majority who are in post-secondary education may still be considered dependent if they are under the age of 25. If you are unsure whether your children are considered dependent, please contact us before ordering the divorce kit.

There are three types of the kit. The type you select from the menus below will depend on whether you have any dependent children of the marriage (definition) and your custody arrangement.
There is no shipping fee if you live in Canada. A shipping fee of $5 applies if the kit needs to be mailed abroad.
Clients Residing In Canada
Use this option only if you have already ordered and received the full Uncontested Divorce Kit, but lost the forms that were included or cannot use them because you made an error and you need the replacement forms. Choose With Children if you have dependent children of the marriage or No Children if you do not have dependent children of the marriage.
Clients Residing Outside Canada
Choose this option if you live outside Canada. A shipping fee of $5 applies.
